By accessing and using Splash Services (operated by Surge Tech Services), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Splash Services provides web hosting, domain registration, email hosting, and related services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

• Web hosting on shared and dedicated servers
• Domain name registration and management
• Email hosting and management services
• SSL certificate provisioning
• Technical support services

3. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy. Prohibited activities include:

• Hosting illegal content or engaging in illegal activities
• Sending spam or unsolicited bulk email
• Distributing malware or engaging in hacking activities
• Hosting content that infringes on intellectual property rights
• Using excessive server resources that impact other users
• Adult content, gambling, or other restricted content

4. Account Terms

You are responsible for maintaining the security of your account and password. Splash Services cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

• You must provide accurate and complete registration information
• You are responsible for all activity that occurs under your account
• You must immediately notify us of any unauthorized use
• We reserve the right to suspend accounts that violate our terms

5. Payment Terms

Payment for services is due in advance. Failure to pay may result in service suspension or termination.

• All fees are non-refundable unless otherwise stated
• Prices are subject to change with 30 days notice
• Late payments may incur additional fees
• You authorize automatic renewal unless cancelled

6. Service Level Agreement

We strive to maintain 99.9% uptime for our hosting services. However, we do not guarantee uninterrupted service and are not liable for downtime due to:

• Scheduled maintenance (with advance notice)
• Events beyond our reasonable control
• Customer-caused issues or policy violations
• Third-party service provider issues

7. Data Backup and Security

While we perform regular backups, you are ultimately responsible for your data. We recommend maintaining your own backups of all important data.

• We are not liable for data loss or corruption
• Backup restoration may incur additional fees
• You agree to implement appropriate security measures

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

9. Limitation of Liability

Splash Services' liability is limited to the amount paid for services. We are not liable for indirect, consequential, or incidental damages.

10. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to services will cease
• Data may be deleted after a grace period
• No refunds will be provided for prepaid services
• These terms continue to apply to past use

11. Governing Law

These terms are governed by the laws of South Carolina, United States. Any disputes will be resolved in the courts of South Carolina.
